AussieGiftCard Terms and Conditions

1. About AussieGiftCard
These Terms apply to competitions, promotions, surveys, offers and related activities conducted through AussieGiftCard.com.
AussieGiftCard operates as a consumer promotions, marketing, co-registration and lead-generation business.
Each Promotion may also have a specific Promotion Schedule describing:
- opening and closing dates;
- prizes;
- eligibility;
- draw dates;
- winner-selection arrangements; and
- other Promotion-specific rules.
2. The Promoter
AussieGiftCard is operated jointly by:
AGC Promotions Pty Ltd ABN 96 617 236 898
and
EMBR Group Pty Ltd ABN 27 417 837 587
Together referred to as:
“AussieGiftCard”, “the Promoter”, “we”, “us” or “our”.
3. Acceptance of these Terms
By entering a Promotion you agree to:
- these Terms;
- the relevant Promotion Schedule;
- the AussieGiftCard Privacy Policy; and
- any additional conditions clearly displayed before you submit your entry.
4. Eligibility
Unless otherwise specified, Promotions are open to:
Australian residents aged 18 years or over.
We may disqualify entries that are:
- fraudulent;
- misleading;
- incomplete;
- automated;
- duplicated contrary to the applicable rules;
- submitted using a false identity; or
- otherwise in breach of these Terms.
5. Entry
Entry must be completed in the manner specified on the relevant entry page.
You may be asked to provide:
- name;
- email;
- telephone number;
- postcode;
- age or date of birth;
- address;
- demographic information;
- survey responses;
- consumer interests;
- product or service interests; and
- other information relevant to the Promotion.
Unless stated otherwise, there is no purchase requirement or entry fee.
6. Co-registration and lead-generation purpose
You acknowledge that AussieGiftCard is not solely a prize-promotion website.
A core commercial purpose of AussieGiftCard is co-registration and lead generation.
Subject to the consent and notices presented when information is collected, AussieGiftCard may:
- identify consumer interests;
- match entrants with relevant products and services;
- provide consumer enquiries or leads to third-party businesses;
- disclose personal information to selected third-party businesses;
- license personal information to selected marketing partners;
- facilitate contact by those businesses;
- undertake data matching, validation and enrichment;
- derive commercial value from information collected through the site; and
- receive fees, commissions, licence fees or other commercial benefits from those activities.

7. Third-party disclosure and marketing
Where you provide the applicable consent, we may disclose your information to selected third-party businesses so that those businesses may contact you about their products or services.
Depending on your consent, recipients may include businesses involved in:
- property;
- property investment;
- real estate;
- mortgages;
- refinancing;
- financial services;
- insurance;
- telecommunications;
- energy;
- solar;
- utilities;
- automotive products;
- consumer credit;
- comparison services;
- household services;
- lifestyle products;
- consumer research;
- marketing; and
- other consumer products and services.
Recipients may include:
- advertisers;
- sponsors;
- lead purchasers;
- data purchasers;
- marketing partners;
- co-registration partners;
- comparison businesses;
- telemarketing businesses; and
- other commercial partners.
The particular businesses or categories may change from time to time.
Where legally required, a relevant third party may be identified before your consent is obtained.
8. Marketing consent
Consent to marketing is governed by the wording presented when you provide your information.
Where an entry form contains an express consent statement, submitting the form means you provide the consent described in that statement.
Depending on the wording presented, this may include permission for:
- AussieGiftCard to contact you;
- AGC Promotions Pty Ltd to contact you;
- EMBR Group Pty Ltd to contact you;
- information to be disclosed or licensed to third-party marketing partners;
- third-party businesses to contact you;
- telephone marketing;
- email marketing;
- SMS marketing;
- co-registration;
- lead referral; and
- other disclosed marketing purposes.
Any consent remains subject to applicable law.
9. Competition entry and marketing consent
Participation in the Promotion and marketing activities are governed by the terms and notices presented at the point of entry.
Withdrawal of marketing consent after entering does not invalidate an otherwise valid Promotion entry or remove an entitlement to a prize already lawfully won.
10. Commercial benefit
You acknowledge that AussieGiftCard may receive:
- lead fees;
- referral fees;
- commissions;
- data-licensing fees;
- marketing fees; or
- other commercial benefits
from third-party businesses in connection with information or enquiries generated through AussieGiftCard.
You are not required to purchase a product or service from a third party merely because your information has been provided to that business pursuant to applicable consent.
11. Evidence of consent
We may retain records concerning your entry and any marketing consent.
Those records may include:
- date;
- time;
- IP address;
- form;
- form version;
- landing page;
- URL;
- privacy notice;
- consent wording;
- campaign source;
- affiliate source;
- publisher source;
- offer;
- email address;
- telephone number;
- answers submitted; and
- relevant marketing permissions.
These records may be retained for:
- compliance;
- auditing;
- consent management;
- dispute resolution;
- fraud prevention;
- data provenance; and
- evidentiary purposes.
12. Entry limits
Unless otherwise stated, only one valid entry per person may be accepted for an individual Promotion.
Duplicate or invalid entries may be excluded.
13. Promotion period
Each Promotion will identify:
- opening date;
- opening time;
- closing date;
- closing time;
- applicable time zone; and
- draw or winner-selection date.
Entries outside the relevant Promotion Period are invalid.
14. Prize pool
The aggregate recommended retail value of all prizes offered in an individual AussieGiftCard Promotion will not exceed AUD $9,000.
AussieGiftCard Promotions are deliberately structured with a maximum total prize pool of AUD $9,000.
If the Promoter proposes a Promotion with prizes exceeding this amount, the Promotion must undergo separate regulatory and legal review before launch.
15. Prizes
The applicable prize or prizes will be described on the relevant Promotion page or Promotion Schedule.
Unless otherwise stated:
- values are expressed in Australian dollars;
- stated values include GST where applicable;
- prizes are not transferable;
- prizes cannot be exchanged for cash unless the prize is expressly a cash or cash-equivalent prize;
- costs not expressly included are the winner’s responsibility; and
- changes in retail value after launch do not entitle a winner to compensation.
Where permitted by law, an unavailable prize may be replaced with a prize of equal or greater value.
16. Trade-promotion compliance
The Promoter intends to conduct each Promotion in accordance with applicable Australian State and Territory trade-promotion laws.
This includes applicable requirements concerning:
- entry;
- eligibility;
- prize descriptions;
- draws;
- winner notification;
- publication;
- unclaimed prizes; and
- record keeping.
17. Winner selection
Where a winner is determined by chance, the winner will be selected using an appropriate random selection method.
The applicable Promotion Schedule will identify:
- draw date;
- draw time;
- location or electronic draw method;
- number of winners; and
- applicable publication arrangements.
18. Winner notification
Winners will be contacted using the details supplied with their entry.
Winner details may also be published where required by applicable law.
19. Claiming prizes
We may require a winner to:
- verify identity;
- demonstrate eligibility;
- confirm age;
- confirm Australian residency;
- provide an Australian delivery address; and
- supply other information reasonably necessary to deliver the prize.
Unclaimed prizes will be dealt with in accordance with applicable law.
20. Personal information
Personal information is handled under the AussieGiftCard Privacy Policy.
That Policy describes:
- co-registration;
- third-party disclosure;
- lead generation;
- data licensing;
- direct marketing;
- marketing partners;
- data matching;
- consent;
- opt-out rights;
- data provenance;
- access and correction rights; and
- transfer of information following a future sale of AussieGiftCard.
21. Opting out
You may withdraw applicable marketing consent or request that AussieGiftCard stop:
- marketing to you;
- using your information for direct marketing; or
- disclosing your information for the purpose of facilitating third-party direct marketing.
Instructions for doing so are provided in the Privacy Policy and applicable communications.
22. Third-party products and services
Third-party products or services marketed to an entrant are provided by the relevant third party unless expressly stated otherwise.
The third party is responsible for:
- its product or service;
- its own representations;
- its privacy practices;
- its marketing activities; and
- compliance with laws applying to it.
Nothing in these Terms excludes responsibility that cannot legally be excluded.
23. Data matching and enhancement
Subject to applicable law and the permissions associated with information, AussieGiftCard may undertake:
- validation;
- deduplication;
- matching;
- segmentation;
- data enrichment;
- contactability checks;
- analytics;
- modelling; and
- consumer profiling for relevant marketing purposes.
24. Intellectual property
Business and intellectual-property rights associated with AussieGiftCard may be owned or controlled by AGC Promotions Pty Ltd and/or EMBR Group Pty Ltd.
These include rights associated with:
- the AussieGiftCard name;
- domains;
- website;
- source code;
- databases;
- database structure;
- marketing systems;
- creative;
- software;
- designs;
- analytics;
- business processes; and
- goodwill.
Third-party intellectual property remains the property of its respective owner.
25. No unrestricted ownership of personal information
Nothing in these Terms means an entrant transfers unrestricted ownership of their personal information to AussieGiftCard.
AussieGiftCard’s ability to collect, hold, use, disclose, license or commercially deal with information remains subject to:
- applicable law;
- consent;
- applicable privacy notices;
- the Privacy Policy;
- opt-outs; and
- statutory consumer rights.
26. Fraud and misuse
We may disqualify an entrant who:
- tampers with a Promotion;
- provides false information;
- impersonates another person;
- attempts to manipulate a draw;
- uses unauthorised automation;
- attempts to compromise our systems; or
- materially breaches these Terms.
27. Technical failures
To the extent permitted by law, we are not responsible for technical failures outside our reasonable control.
If a technical problem materially affects a Promotion, we may take reasonable corrective action permitted by law.
28. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot legally be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
29. Liability
To the maximum extent permitted by law, the Promoter is not liable for indirect or consequential loss arising from participation in a Promotion.
Nothing in these Terms excludes liability where exclusion would be unlawful.
30. Sale or transfer of AussieGiftCard
The AussieGiftCard business may be:
- sold;
- acquired;
- merged;
- restructured;
- financed; or
- transferred to another operator.
Subject to applicable law, assets transferred as part of such a transaction may include:
- domains;
- brand;
- website;
- intellectual property;
- databases;
- consumer records;
- lead records;
- consent records;
- data provenance;
- suppression records;
- marketing infrastructure;
- contracts;
- business relationships;
- technology;
- historical business records; and
- goodwill.
Personal information may be transferred where lawful and subject to the AussieGiftCard Privacy Policy.
A purchaser or successor takes the information subject to:
- existing consent;
- applicable privacy laws;
- applicable marketing laws;
- opt-outs;
- suppression records; and
- other applicable restrictions.
31. Assignment
AGC Promotions Pty Ltd and EMBR Group Pty Ltd may, to the extent permitted by law, assign or novate rights associated with the AussieGiftCard business in connection with a bona fide:
- business sale;
- asset sale;
- merger;
- acquisition;
- restructure; or
- transfer of the Business.
32. Changes to these Terms
These Terms may be updated prospectively.
We will not retrospectively amend a Promotion in a way that unlawfully prejudices existing entrants or winners.
Changes to these Terms do not retrospectively create additional marketing consent.
33. Governing law
These Terms are governed by the laws of Victoria, Australia, except where another Australian jurisdiction’s mandatory legislation applies.
