AussieGiftCard is operated jointly by:

Together referred to in this Privacy Policy as “AussieGiftCard”, “we”, “us” or “our”.
AussieGiftCard operates consumer promotions, competitions, surveys, marketing campaigns, co-registration programs, lead-generation activities and consumer-information services.
An important part of the AussieGiftCard business is the collection of consumer information and, where permitted by law and the consent provided by the consumer, the disclosure or licensing of that information to selected third-party businesses so those businesses may market relevant products or services directly to consumers.
AGC Promotions Pty Ltd and EMBR Group Pty Ltd jointly operate the AussieGiftCard business, website, databases, intellectual property and associated commercial activities.
Each company is responsible for complying with applicable Australian privacy laws in relation to personal information that it collects, holds, uses or discloses.
This Privacy Policy explains how we collect, hold, use and disclose personal information, including how information may be used for:
- competitions and promotions;

- co-registration;
- lead generation;

6. AussieGiftCard’s co-registration and lead-generation model
A core commercial purpose of AussieGiftCard is co-registration and lead generation.
This means that when you enter an AussieGiftCard promotion, complete a survey, select an offer, indicate an interest in a product or service, or otherwise provide your details, we may ask for your permission to provide those details to selected third-party businesses.
Where the applicable consent or notice permits us to do so, we may:
- disclose your information to another business;
- provide your information as a consumer enquiry or lead;
- license your information to selected businesses;
- facilitate contact between you and another business;
- match you with businesses offering products or services potentially relevant to you;
- permit selected businesses to contact you directly;
- receive a fee or commission for providing your information or enquiry; and
- derive other commercial benefit from those activities.
A third-party business receiving your information may use it to market its own products or services, subject to:

Where applicable law requires a third party to be specifically identified before it contacts you, the relevant business or businesses may be identified:
- on the entry form;
- in the survey;
- beside the relevant offer;

- through a linked partner list; or
- through another appropriate disclosure provided before consent is obtained.
8. Commercial benefit
AussieGiftCard is a commercial business.
We may receive money, fees, commissions, licence fees, referral fees or other commercial benefits when we provide, disclose or license personal information, consumer enquiries or leads to third-party businesses.
Your entry into an AussieGiftCard competition does not mean that you are required to purchase a product or service from any third-party business.
9. Why we collect, use and disclose information
We may collect, hold, use and disclose information for purposes including:

- preventing duplicate or fraudulent entries;
- conducting draws;

10. Consent to third-party contact

- other communication methods expressly disclosed to you.
Where a particular offer relates to a specific business, we may provide your details to that business where the consent associated with that offer permits us to do so.

11. Direct marketing by AussieGiftCard
Where permitted by law, AussieGiftCard may also contact you directly with:

- promotions;
- surveys;
- commercial offers;
- relevant products and services; and
- marketing from AussieGiftCard or its related businesses.
Marketing may occur through:
- telephone;
- email;
- SMS;
- online advertising;
- social media;
- postal mail; and
- other lawful channels.
12. Your right to opt out
You may at any time ask us to:
- stop sending you marketing;
- stop using your personal information for direct marketing;
- stop disclosing your personal information for the purpose of facilitating direct marketing by other businesses; or
- update your marketing preferences.
There is no charge for doing so.
You may opt out through:
- an unsubscribe facility provided in a communication; or
- contacting AussieGiftCard.
We may retain limited information on a suppression or do-not-contact list so that your opt-out can continue to be honoured.
Withdrawal of consent does not invalidate lawful uses or disclosures undertaken before your withdrawal took effect.
Where your information has already been lawfully provided to a third-party business, that business may separately hold your information. You may also need to contact that business regarding its future marketing.
13. Spam Act and electronic communications
Where we or another business sends commercial electronic messages by email, SMS, MMS or similar methods, the Spam Act 2003 (Cth) may apply.
Applicable communications must comply with legal requirements concerning:
- consent;
- sender identification; and
- unsubscribe functionality.
We may retain records necessary to demonstrate how consent was obtained.
14. Telephone marketing and the Do Not Call Register
Telephone marketing may be governed by the Do Not Call Register Act 2006 (Cth) and related requirements.
Where required, telephone marketing may only occur where:
- the telephone number is permitted to be called;
- the consumer has provided applicable consent; or
- another lawful exemption applies.
Consent may be withdrawn.
15. Data matching, validation and enhancement
Where permitted by law, we may:

- determine whether contact details remain active;
- deduplicate records;
- standardise addresses;
- match information collected at different times;
- supplement information with lawful third-party information;
- create segments;
- analyse consumer interests;

- the Philippines; and
- other jurisdictions used by relevant providers.
Where Australian privacy law imposes requirements relating to overseas disclosure, we will take the steps required by law.

We take reasonable steps to protect information against:
- misuse;
- interference;
- loss;
- unauthorised access;
- unauthorised modification; and
- unauthorised disclosure.
Where a data breach occurs, we will respond in accordance with applicable law, including the Notifiable Data Breaches scheme where applicable.
20. Retention of information
We retain information for as long as reasonably necessary for lawful business purposes.
This may include retaining records for:
- ongoing marketing permissions;
- lead-generation activities;
- consent evidence;
- data provenance;
- compliance;
- auditing;
- contract management;
- fraud prevention;
- disputes;
- legal obligations; and
- suppression records.
Where information is no longer required to be held, we will take reasonable steps to destroy or de-identify it where required by law.
21. Access and correction

You may also request correction where information is:

We may require identity verification.

23. Sale or transfer of AussieGiftCard
The AussieGiftCard business may be:
- sold;
- acquired;
- merged;
- restructured;
- financed;
- transferred; or
- otherwise become operated by another entity.
Subject to applicable law, information associated with AussieGiftCard may form part of such a transaction.
This may include:
- consumer databases;
- lead databases;
- consent records;
- provenance records;
- suppression records;
- business records;
- contracts;
- marketing systems; and
- other information associated with the operation of AussieGiftCard.
Due diligence
Information may be disclosed to prospective purchasers, investors, financiers and advisers where lawful and reasonably necessary.
Where reasonably practicable, preliminary due-diligence information will be:
- aggregated;
- anonymised;
- de-identified; or
- otherwise restricted.
Completed sale
Where AussieGiftCard or its relevant assets are lawfully transferred to a purchaser or successor, associated personal information may also transfer where permitted by law.
The successor takes the information subject to:
- applicable privacy law;
- existing consent;
- applicable marketing permissions;
- opt-outs;
- suppression records; and
- other applicable restrictions.
A change in ownership does not itself create permission for unrelated new uses of personal information.
24. Ownership of AussieGiftCard business assets
AGC Promotions Pty Ltd and EMBR Group Pty Ltd jointly operate AussieGiftCard and may jointly own or control commercial rights associated with:
- the brand;
- domains;
- websites;
- intellectual property;
- databases;
- database infrastructure;
- consent records;
- provenance records;
- systems;
- contracts;
- business relationships;
- analytics;
- goodwill; and
- other Business Assets.
This does not mean personal information is owned as unrestricted property.
Individual privacy rights remain subject to applicable law.
25. Children
AussieGiftCard promotions are intended for persons aged 18 years or over.
We do not knowingly use information collected through adult promotions to market directly to children.
26. Complaints
Privacy complaints may be directed to our Privacy Officer.
We will investigate complaints and respond within a reasonable period.
If you are dissatisfied with our response, you may have the right to complain to the Office of the Australian Information Commissioner (OAIC).
27. Changes to this Privacy Policy
We may amend this Privacy Policy from time to time.
The current version will be published on AussieGiftCard.com.
An amendment does not retrospectively create consent that was not validly obtained at the time information was collected.
